1.2 The purpose of this company are recruitment services.
1.3. All data processing is based on the purpose of this company. This includes the evaluation of applications for a possible placement in other companies. Data processing that is not carried out to fulfill the purpose of the business requires its own legal basis, which must be specified in each respective case.
2. Handling of personal data
2.1 Talent Tree processes personal information for the purpose of customer management (these are the points of contact between employers that are looking for workers) and job placement (natural persons to be referenced by Talent Tree to potential employers).
In addition, in the event of a claim by an affected party, the date of the request will be processed according to this purpose. Requests via email with the purpose of acquiring information are also processed. All of the above furthermore pertains to applicants who apply through any of the Talent Tree websites.
2.2 The legal bases of the data processing are linked to the purpose and therefore, as well as the retention periods, may differ.
In the case of customer administration, the fulfillment of the contract (Art. 6 (1) (b) DSGVO) applies. At this point we refer to our terms and conditions, in which the contracting party is obliged to inform its employees (natural persons by law thus pertaining to contact personnel) sufficiently about the data processing in regards to the contractual relationship with Talent Tree. Furthermore, the contracting party is obliged to provide the conditions which guarantee a legal basis regarding the processing of personal data .
The processing of applicant data pertains to a different legal bases.
An unsolicited application or the approach of a candidate to Talent Tree is based on the legal basis of the conclusive consent or the legitimate interest with regard to further processing and transmission of the data in regards to potential employers. At Talent Tree, we are always looking for new talent and thus extend our search to social media. The collection of personal data from these media outlets takes place on the legal basis of the publication (Art. 9 (2) lit. DSGVO) or implied consent (for example, if the person in question has indicated that they are seeking new professional challenges). Another possibility that includes applicants in our database is a recommendation. Here processing is based exclusively on an immediately requested consent to processing. If this is not given or withdrawn at a later date, the data will be deleted immediately.
When we include an applicant (more specifically, his or her data for referral to potential employers) in our system, we strive to create a successful link between the person (applicants) and our clients (employers). This process will not take more than 9 months in total. If a cancellation is made, then according to § 15 Abs 4 AGG a legal storage of the data is valid in order to oppose any potential disadvantages on the side of the applicant. If a storage in the database is to take place beyond this period of 9 months (for the purpose of requesting and arranging similar or further job offers), a separate consent of the person in question has to be obtained.
2.3 Your applicant data will be kept for a period of 9 months. Any additional storage requires a separate consent. The mentioned customer data is kept for a period of 7 years.
2.4 Personal data that we process for the purposes of the applicant’s placement are limited to:
- Name, email, address, telephone, link to social network profile and master data from CV if available (includes previous positions, companies, possibly interests and hobbies, date of birth, education)
- Interest of the candidate in the vacant position (= yes or no)
- Professional experience, personal interests, salary expectations, motivation to change
2.5 Personal data of applicants will be passed on to our customers (potential employers). The following data is included:
- Name, email, address, telephone, CV, work experience, personal interests, salary expectations, motivation to change
Talent Tree also stores:
- Feedback pertaining to the customer
- Starting time of the candidate, contract, and salary
2.6 The following categories of recipients receive personal information from us:
- Customers: applicant data (see above)
- Data processors: Webnique, Starhunter, Slack, GSuite
2.7 Notice of consent: The affected person can withdraw their consent at any time. Thereafter, the data is irretrievably deleted. An informal message via email is sufficient. The legality of the data processing carried out until the time of revocation remains unaffected by the revocation.
2.8 Notice regarding the data processing based on a legitimate interest: The data subject can object to this processing at any time.
2.9 What rights do you have regarding your data?
At any time you have the right to obtain free information about the origin, recipient, and purpose of your stored personal data. You also have the right to request the correction, blocking or deletion of this data. For this purpose and for further questions about data protection, you can contact us at any time with the address given in the imprint. You also have the right to request data that we process on the basis of your consent or in fulfillment of a contract – in regards to itself or a third party – in a standard, machine-readable format. 3. Usage of the Talent Tree Website
3.1 General Information
How do we collect your data?
Data is automatically collected by our IT systems when you visit our website. These are mostly technical data (for example data regarding your internet browser, operating system or time of the page request). The collection of this data is done automatically as soon as you enter our website.
What is the purpose of data collection?
Part of the data is collected to ensure a flawless provision of the website. Other data can be used to analyze user behavior.

This site uses an SSL or TLS encryption for security reasons and in order to protect the transmission of confidential content such as orders or requests that you send to us as the site operator. In order to host this site we partner with WPEngine (WPEngine, Inc) that is based in London UK. The corresponding data related to our offerings are stored in Europe. WPEngine is certified according to the EU-American and the Swiss-American Privacy Shield and thus ensures adequate data protection.
Our internet pages use so-called cookies. Cookies do not harm your computer and do not contain viruses. Cookies serve to make our website more user-friendly, effective and secure. Cookies are small text files that are stored on your computer and stored by your browser.

An informal message by email to us is sufficient. The legality of the data processing operations carried out until the time of revocation remains unaffected by the revocation.
The information you provide in the contact form will be stored by us until you ask us to delete it, revoke your consent to storage, or when the purpose for data storage loses its validity (for example, after your request has been processed). Mandatory statutory provisions – especially retention periods – remain unaffected.
Registration on this website
You can register on our website to use additional features on the site. We solely use the data you enter for the purpose of using the respective offer or service for which you have registered. When you visit a page that contains such a plugin, your browser connects directly to the servers of Pinterest. The plugin transmits protocol data to the server of Pinterest in the USA. This log data may include your IP address, the address of the websites visited that incorporates Pinterest features, browser type and settings, the date and time of the request, how you use Pinterest, and cookies.

5.4 Google AdWords and Google Conversion Tracking

5.6 Facebook pixels

The data given to us for the purpose of obtaining the newsletter will be saved until your cancellation and will be deleted after you unsubscribe from the newsletter. Data that we have stored for other purposes (such as respective email addresses pertaining to the members area) remain unaffected.
6.2 Campaign Monitor
This website regularly sends email newsletters to customers and interested parties who have subscribed to our mailing list. In order to send our newsletter, we use the list provider Campaign Monitor (404 / 3-5 Stapleton Ave, Sutherland NSW 2232, Sydney, Australia).
When you sign up for our newsletter, your data (name, email address) will be transmitted to Campaign Monitor and stored there. The service provider Campaign Monitor is based in Australia and the respective data is processed on servers and data centers located in the USA. During registration, you will be asked to confirm your registration by marking a separate box. After logging in, you will receive an email by Campaign Monitor to confirm your login. Campaign Monitor offers extensive analyzing capabilities on how to open and use the newsletters. This analysis is group-related and are not used by us for the individual evaluation of newsletter recipients.
